Welcome to Dark Matter. These terms govern your use of our OTA update platform for React Native applications. By using Dark Matter, you agree to these terms.
Plain English summary: Be a good citizen, pay for what you use, and we'll do our best to keep your updates flowing reliably.

1. The Service
Dark Matter provides over-the-air (OTA) update delivery for React Native applications. This includes:
- The Dark Matter TUI (Terminal User Interface) for deploying updates
- The Dark Matter SDK for receiving updates in your app
- Cloud infrastructure for storing and delivering update bundles
- Real-time metrics and monitoring
We reserve the right to modify, suspend, or discontinue any part of the service with reasonable notice.
2. Your Account
To use Dark Matter, you need to create an account. You agree to:
- Provide accurate information during registration
- Keep your API keys and credentials secure
- Notify us immediately if you suspect unauthorized access
- Be responsible for all activity under your account
You must be at least 18 years old or have legal authority to bind your organization to these terms.
3. Acceptable Use
You agree NOT to use Dark Matter to:
- Distribute malware, viruses, or malicious code
- Violate any laws or regulations
- Infringe on intellectual property rights
- Distribute content that is illegal, harmful, or offensive
- Attempt to circumvent usage limits or security measures
- Resell or redistribute the service without authorization
- Interfere with or disrupt the service or its infrastructure
We reserve the right to suspend or terminate accounts that violate these terms.
4. Payment Terms
For paid plans:
- Billing: Subscriptions are billed monthly or annually in advance
- Payment: We accept major credit cards via Stripe
- Upgrades: Take effect immediately; you'll be charged the prorated difference
- Downgrades: Take effect at the end of your current billing cycle
- Refunds: Full refund within 14 days of initial purchase if you're not satisfied
- Cancellation: You may cancel anytime; service continues until end of paid period
Prices are in USD and exclude applicable taxes. We may change pricing with 30 days notice.
5. Usage Limits
Each plan includes specific limits on apps and monthly updates. If you exceed your limits:
- We'll notify you at 80% and 100% of your limit
- We provide a grace period for occasional overages
- Consistent overages require upgrading to an appropriate plan
- We won't cut off your updates mid-rollout without warning
6. Your Content
"Your Content" means the update bundles and data you upload to Dark Matter.
- You retain ownership of Your Content
- You grant us a license to store, transmit, and deliver Your Content as needed to provide the service
- You are responsible for ensuring Your Content doesn't violate laws or third-party rights
- We don't monitor Your Content, but may remove it if we believe it violates these terms
7. Intellectual Property
Dark Matter, including its TUI, SDK, documentation, and branding, is owned by us and protected by intellectual property laws. You may use our SDK and tools as intended to build and deploy your applications.
You may not copy, modify, or reverse-engineer our software except as permitted by applicable law or with our written permission.
8. Privacy
Our Privacy Policy explains how we collect, use, and protect your data. By using Dark Matter, you agree to our privacy practices.
9. Disclaimer of Warranties
Dark Matter is provided "as is" and "as available." We make no warranties, express or implied, including:
- That the service will be uninterrupted or error-free
- That the service will meet your specific requirements
- That any errors will be corrected
We work hard to provide reliable service, but software has bugs and infrastructure has outages. We can't guarantee perfection.
10. Limitation of Liability
To the maximum extent permitted by law:
- We are not liable for indirect, incidental, special, consequential, or punitive damages
- Our total liability is limited to the amount you paid us in the 12 months before the claim
- We are not liable for losses caused by your misuse of the service, third-party actions, or events beyond our control
Some jurisdictions don't allow these limitations, so they may not apply to you.
11. Indemnification
You agree to indemnify and hold us harmless from claims, damages, and expenses (including legal fees) arising from:
- Your use of the service
- Your Content
- Your violation of these terms
- Your violation of any third-party rights
12. Termination
Either party may terminate this agreement at any time:
- You: Cancel your subscription through your account settings
- Us: We may suspend or terminate your account for violations of these terms, with notice when practical
Upon termination, your right to use the service ends. We may delete Your Content after a reasonable retention period (typically 30 days).
13. Changes to Terms
We may update these terms from time to time. We'll notify you of material changes via email or through the service. Continued use after changes constitutes acceptance.
14. General
- Governing Law: These terms are governed by the laws of the State of Delaware, USA
- Disputes: Any disputes will be resolved in the courts of Delaware
- Entire Agreement: These terms constitute the entire agreement between you and Dark Matter
- Severability: If any provision is found unenforceable, the rest remain in effect
- No Waiver: Failure to enforce a provision doesn't waive our right to enforce it later
